In a landmark first decision in Canada, with many likely to follow, the B.C. Supreme Court has considered the question of whether an employee’s refusal to comply with their employer’s vaccination policy amounts to a constructive dismissal. In Parmar v Tribe Management Inc., Justice Heather MacNaughton found it did not, meaning employees choosing to not comply with their employer’s policy may find themselves bereft of employment, severance and the ability to access employment insurance.
