Senior Partner Robert Taylor recently succeeded in a motion to cross-examine a Defendant’s deponent on her affidavit while blocking cross-examination on the Plaintiff’s affidavit. Master Sugunasiri held that the Plaintiff was entitled to file a motion without a supporting affidavit by enclosing documents in the motion record the validity of which was not in issue, thus thwarting the Defendants attempt to seek to examine on the attached documents.  Concurrently, Master Sugunasiri held that as the Defendant’s affidavit contained subjective commentary on its attached documents, the Plaintiff is entitled to examine the witness who swore the affidavit.
